Tried a NZB that i already know has been hit with a DMCA takedown notice, the Pre-checker check the nzb and assumes its fine, it will then attempt to download the file with every single file broken.

Some Usenet servers found a new way to annoy their customers.
Instead of just removing a post they replace the articles with fake articles, saying they took the post down.
The pre-check only asks the server whether it has an article, not to send it.

I have 2 servers a main and a backup (fill server) does the pre-checker check against a backup server or will it only use the main server?

Pre-check is based on asking the server for article presence.
If your primary server says it has (because it has the fake article), the backup won't be asked.
SABnzbd cannot ask for the content, because that would defeat the whole purpose.
Assuming you're using 0.7.1, the real download will retry with the backup server, because the
article from the primary will be invalid.
Make sure you have "Fail on yEnc CRC Errors" in Config-Switches on.
